Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Consumer: Any natural person not acting for purposes related to their trade, business, craft, or profession who enters into a distance contract with Clara Canada.

Merchant: The legal entity offering products or services to consumers at a distance, referred to as Clara Canada.

Distance Contract: An agreement concluded between Clara Canada and the consumer under an organized system for distance selling, using one or more means of remote communication.

Right of Withdrawal: The consumer’s legal right to withdraw from a contract within a specific cooling-off period, in accordance with Canadian consumer protection laws.

Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

Day: Calendar day.

Means of Distance Communication: Any medium that can be used to conclude a contract without physical presence of the parties.


Article 2 – Applicability

These Terms and Conditions apply to all offers, orders, and agreements concluded via the official website of Clara Canada.

Before the conclusion of any distance contract, these Terms will be made available to the consumer. If this is not reasonably possible, Clara Canada will inform the consumer how the Terms can be accessed electronically.

By placing an order, the consumer confirms that they have read, understood, and agreed to these Terms.

In the event of conflict between these Terms and any supplementary conditions, the provisions most favorable to the consumer shall prevail, consistent with Canadian consumer law.


Article 3 – The Offer

The offer includes a complete and accurate description of the products and services offered. Clara Canada reserves the right to correct typographical or pricing errors at any time.

Each product listing provides essential information such as price, description, materials, and delivery expectations.

All images are for illustrative purposes only. Actual colors and details may vary slightly due to screen settings or production variations.

If an offer has limited validity or specific conditions, this will be stated explicitly.


Article 4 – The Agreement

The contract is formed when the consumer accepts the offer and fulfills all stated conditions, including payment.

Upon receiving an online order, Clara Canada will confirm the acceptance electronically via email.

Clara Canada reserves the right to refuse or cancel any order if fraud, payment irregularities, or misuse is suspected.

The consumer is responsible for providing accurate personal and delivery information. Clara Canada is not liable for losses resulting from incorrect information provided by the customer.


Article 5 – Right of Withdrawal

Consumers may withdraw from the purchase within 30 days of delivery without stating a reason.

To exercise this right, the consumer must notify Clara Canada in writing via info@claracanada.com within the 30-day window.

Returned products must be unused, in original packaging, and include all tags and accessories.

Returns must be sent to the designated return address provided by Clara Canada’s customer service team.

The consumer is responsible for return shipping costs unless the item was defective or incorrect.

Once the return is received and inspected, Clara Canada will issue a refund within 14 business days, excluding shipping costs.

Items marked Final Sale, Seasonal Sale, or Personalized are non-returnable.


Article 6 – Price, Taxes, and Customs

All prices are displayed in Canadian dollars (CAD) unless otherwise stated.

Clara Canada reserves the right to adjust prices at any time. Price changes do not affect orders already confirmed.

Prices exclude any import duties, customs fees, or taxes applicable in the consumer’s country or province outside of Canada.

For international customers, the consumer is responsible for all applicable import duties, taxes, or customs clearance fees required by local authorities.

Clara Canada is not responsible for delays caused by customs processing or non-compliance with import regulations.


Article 7 – Payment

Payments must be made in full at the time of purchase through approved payment methods such as credit card, PayPal, or other options displayed at checkout.

Clara Canada uses secure, encrypted payment gateways to ensure the protection of consumer data.

Orders will not be processed until payment is successfully received.

Clara Canada reserves the right to cancel any unpaid or incomplete orders after a reasonable period.


Article 8 – Delivery and Fulfillment

Orders are shipped to the delivery address specified by the consumer during checkout.

Clara Canada partners with established logistics and fulfillment providers; average delivery time ranges between 5–10 business days within Canada and 7–14 business days internationally, depending on destination.

Delays may occur due to customs inspection, weather conditions, or logistical factors beyond Clara Canada’s control.

The consumer is responsible for tracking shipments using the provided tracking number.

If a package is returned due to an incorrect address, refusal, or failure to collect, a reshipping fee may apply.

Clara Canada is not liable for loss or damage after delivery confirmation from the shipping carrier.


Article 9 – Conformity and Warranty

Clara Canada guarantees that all products conform to their description and are fit for their intended use.

Any defective or incorrect items must be reported within 5 days of receipt, accompanied by clear photographic evidence.

Products purchased during clearance or promotional sales are not covered by warranty unless the defect existed upon delivery.

Clara Canada reserves the right to replace, repair, or refund defective items after review and assessment.


Article 10 – Limitation of Liability

Clara Canada shall not be held liable for indirect, incidental, or consequential damages arising from the use or inability to use products purchased from the website.

In no event shall Clara Canada’s total liability exceed the amount paid by the consumer for the product in question.

Clara Canada is not responsible for delays, errors, or damages caused by third-party logistics providers, customs, or carrier services.


Article 11 – Intellectual Property

All content on the Clara Canada website, including text, images, designs, and trademarks, is the property of Clara Canada or its licensors.

Reproduction, modification, or distribution of any material from the site without written permission is strictly prohibited.


Article 12 – Personal Data and Privacy

Clara Canada handles all personal data in accordance with its Privacy Policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial privacy legislation.

Personal information is collected solely for order processing, communication, and service improvement.

Article 13 – Complaints and Disputes

Complaints must be submitted in writing via info@claracanada.com within 7 days of identifying the issue.

Clara Canada will respond to all complaints within 14 days.

If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Ontario, Canada.


Article 14 – Governing Law

All agreements, transactions, and disputes are governed exclusively by the laws of Canada and, where applicable, the laws of the Province of Ontario, regardless of the customer’s country of residence.


Article 15 – Modifications to Terms

Clara Canada reserves the right to modify these Terms and Conditions at any time.

Updated versions will be published on the website and apply immediately to all new transactions.

Continued use of the website after such changes implies acceptance of the revised Terms.
